BUYER
The person placing an order on artopol.com. The buyer's name, delivery and billing address, phone number and email address are the details provided by the buyer during the order.
2. Subject
This agreement sets out the rights and obligations of the parties regarding the sale and delivery of the artwork / product ordered electronically by the buyer on artopol.com, whose characteristics and sale price are stated in the order summary, in accordance with Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.
3. Product and Payment Details
The type, main characteristics (artist, technique, size), quantity, sale price including taxes and payment method of the product are shown on the order completion page and in the order confirmation email sent to the buyer. The order summary and the confirmation email form an integral part of this agreement.
Payment is taken securely by credit / debit card through a licensed payment institution. Card details are neither seen nor stored by the seller. For instalment payments, the terms between the buyer and the issuing bank apply.
4. Delivery
After the payment is confirmed, the product is delivered against signature to the delivery address provided by the buyer, by a contracted courier or specialised art shipping company, within the legal period of 30 (thirty) days at the latest. The buyer should inspect the package on delivery. If any damage to the package or the product is noticed, a damage report must be issued by the courier. If the seller is unable to deliver the product in time for any reason, the buyer is informed and the amount paid is refunded within 14 (fourteen) days.
5. Right of Withdrawal
The buyer may withdraw from the agreement within 14 (fourteen) days of receiving the product, without giving any reason and without penalty. The withdrawal notice must be sent in writing to info@artopol.com within this period. Details are available on the Exercising the Right of Withdrawal page.
The price is refunded by the same payment method within 14 (fourteen) days of the seller receiving the withdrawal notice. The buyer returns the product complete and undamaged, in its original packaging and with its certificate (if any), within 10 (ten) days of the withdrawal notice.
Under Article 15 of the Regulation on Distance Contracts, the right of withdrawal does not apply to products made to the buyer's specifications or personal needs (such as commissioned artworks).
6. General Provisions
The buyer confirms having read the preliminary information on the main characteristics, sale price, payment method and delivery of the product and having given the required electronic approval. If the ordered product is out of stock or cannot be supplied, the seller informs the buyer and refunds the amount collected within 14 (fourteen) days.
7. Disputes
Disputes arising from this agreement are handled by the Consumer Arbitration Committees at the place of residence of the buyer or the seller within the monetary limits announced annually by the Ministry of Trade of the Republic of Türkiye, and by the Consumer Courts above these limits.
8. Entry into Force
This agreement enters into force when the buyer completes the order after confirming on the payment page that they have read and accept it. A copy of the agreement is made available to the buyer together with the order confirmation email.
